Parkland Refining BC LTD. (PRBC) 2018 Fall Promotion – Win Now Win Later Contest Rules (the “Rules”)
PARTICIPATION IN THE CONTEST CONSTITUTES AN ACKNOWLEDGEMENT THAT YOU HAVE READ, UNDERSTOOD, AND FULLY AND UNCONDITIONALLY AGREE AND ACCEPT THESE RULES.
1. HOW TO OBTAIN A COPY OF THE RULES
1.1. To Obtain a Copy of the Rules: For a copy of the Rules, please visit www.chevron2win.ca or write to Chevron Win Now, Win Later Contest, c/o Contest Administrator 1200-1050 West Pender Street Vancouver, British Columbia, V6E-3T4
1.2. Amendments to the Rules: The contest sponsor reserves the right to amend these Rules at any time and without notice.
2. HOW TO PARTICIPATE
2.1. Sponsor:The sponsor of this contest is Parkland Refining BC Ltd. (PRBC)
2.2. Contest Period:The contest is open from 12:00 a.m., Pacific Time, October 1, 2018 to 11:59 p.m., Pacific Time, November 11, 2018 (the “Contest Period”).
2.3 Eligibility: The contest is open to all residents of Canada who have reached the age of majority in their province or territory of residence, except:
(i) residents of the province of Quebec, and (ii) employees of PRBC, its affiliated companies, franchisees, agents, associates, dealers, representatives or their respective advertising or promotional agencies, or the third parties engaged by PRBC to assist it in administering the contest or a member of any such employee’s immediate family (regardless of where they live) or persons living under the same roof (whether related to the employee or not), (“Eligible Entrants”). In these rules, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partner and/or spouse.
2.4 How to Enter: During the Contest Period, each time an Eligible Entrant makes a minimum $5 purchase at any Chevron branded gas station in the province of British Columbia or store with a Chevron branded gas dispenser in the Province of British Columbia (each a “Chevron Location”), they are eligible to receive one ticket (a “Ticket”) from the cashier. Limit of one Ticket per purchase.
Each Ticket has two parts: (i) an instant win section (the “Instant-Win Section”), and (ii) a grand prize entry section (the “Grand Prize Entry Section”) containing a unique alphanumeric code (a “Code”). An Eligible Entrant enters the Instant Win Section of the contest by breaking open the window in the Instant-Win Section of the Ticket, and enters the Grand Prize draw by visiting www.chevron2win.ca and completing all fields of the online entry form, which includes their contact details and the Code, before the end of the Contest Period. Limit of ten (10) Grand Prize entries per day per Eligible Entrant. PRBC reserves the right to disqualify any Grand Prize entry which PRBC determines, in its sole discretion, does not comply with the Rules.
2.5 No Purchase Necessary: No purchase is necessary to enter the contest. Eligible Entrants may request a Ticket by sending by mail a hand written, original (not mechanically reproduced), distinctly worded, 250 word or more description of why they shop at Chevron with a self-addressed stamped envelope that is at least 8cm by 12cm in size to: Chevron Win Now, Win Later Contest, c/o Contest Administrator, 1200-1050 West Pender Street, Vancouver, British Columbia, V6E3T4. To be eligible for a Ticket, mail-in requests for Tickets must be received within the Contest Period. PRBC accepts no responsibility for ensuring that a Ticket is mailed to or received by an Eligible Entrant before the end of the Contest Period. Limit of one Ticket per envelope.
3.1 Prizes: In total, up to a maximum of two hundred and four thousand, six hundred and ninety-four (204,694) prizes will be available to be awarded to Eligible Entrants through the contest, as follows: (i) A maximum of two hundred four thousand, five hundred and fifteen (204,515) instant win prizes (each an “Instant Win Prize”), and (ii) A maximum of one hundred eighty-three (183) grand prizes (each a “Grand Prize”). If a prize cannot be awarded as described in these Rules, PRBC reserves the right to substitute a prize or prize component with another of comparable value, as determined in its sole discretion.
3.2 Instant Win Prizes: The Instant Win Section two hundred four thousand, five hundred and fifteen (204,515) of the Tickets will include the details of an Instant Win Prize (each, an “Instant Win Ticket”). The Instant Win Prizes, their approximate retail value, the quantity of Instant Win Prizes in the contest and the odds of winning are as follows:

To be declared an Instant Win Prize winner, an Eligible Entrant holder of an Instant Win Ticket must correctly answer, without assistance, the mathematical, skill-testing question printed on the Instant Win Ticket. Winners claim their Instant Win Prize by (i) surrendering their Instant Win Ticket, marked with the correct answer to the skill testing question, and (ii) presenting government issued identification proving the Eligible Entrant’s age and place of residence, at any Chevron branded Location that has the Instant Win Prize (as identified on the Instant Win Ticket) available. By claiming their Instant Win Prize, an Eligible Entrant confirms they answered the skill testing question without assistance. Winners must claim their Instant Win Prize on or before 11:59 p.m., Pacific Time, December 31, 2018 (the “Instant Win Deadline”). All Instant Win Prizes not claimed by the Instant Win Deadline will be null and void.
3.3 Grand Prizes: Each Grand Prize consists of one thousand dollars ($1,000) in Chevron gift certificates, redeemable only at Chevron Locations. The Grand Prize must be accepted as awarded and will have no cash surrender value. There will be up to one hundred eighty-three (183) Grand Prize winners (one for each Grand Prize). A draw for the Grand Prizes will be made by a random computer-generated selection on or around November 14, 2018, from all entries made in accordance with section 2.4 during the Contest Period (the “Grand Prize Draw”). If an individual Eligible Entrant’s name is drawn more than once in the Grand Prize Draw, they are eligible for only one (1) Grand Prize.
Eligible Entrants selected in the Grand Prize Draw will be contacted by email or telephone at the telephone number or email address provided in their Grand Prize entry within the ten (10) business days following the Grand Prize Draw (the “Contact Period”). At least two (2) attempts to contact the selected entrant will be made within the Contact Period. PRBC is not responsible for contacting an entrant who provided incorrect or incomplete information and will not be responsible for failed attempts to contact an entrant.
In order to win the Grand Prize, within 7 days of the grand prize draw, the selected entrant must first: (i) correctly answer, without assistance, a time limited, mathematical, skill-testing question to be administered by telephone, and (ii) sign and return a form confirming that the selected entrant is an Eligible Entrant, has complied and will comply with the Rules, gives permission to PRBC to refer to him/her as a Grand Prize winner and to use his/her name, city of residence, photograph, video or likeness for advertising or publicity purposes and on the contest website and in other media without payment or further compensation, accepts the Grand Prize as awarded, and releases PRBC, its affiliated companies, franchisees, agents, associates, dealers, representatives or their respective advertising or promotional agencies, or the third parties engaged by PRBC to assist it in administering the contest (together, the “Contest Parties”) from all liability (the “Declaration and Release Form”). The selected entrant will have seven (7) days to return the signed Declaration and Release Form upon receipt. Once declared a winner, the selected entrant will be directed as to how to claim their prize. If a selected entrant cannot be contacted within the Contact Period (7 days) , does not correctly answer the skill-testing question, or does not sign and return the Declaration and Release Form within the period specified above, the selected entrant’s right to the Grand Prize will be forfeited and they will have no further recourse towards any of the Contest Parties. PRBC shall have the right to randomly draw another Eligible Entrant’s name and PRBC shall be fully and completely released and discharged from any liability or responsibility in this regard.
3.4 Odds of Winning: The overall odds of winning an Instant Win Prize are 1 in 6, based on three hundred and twenty thousand eight hundred and ninety-six (320,896) Instant Win Tickets out of a total number of one million, five hundred thousand (1,500,000) Tickets. The specific odds of winning a particular type of Instant Win Prize are set out in section 3.2 of the Rules. The odds of winning a Grand Prize are 1 in 8,308, based on an estimated total of potential eligible entries of one million, five hundred thousand (1,500,000), being the number of Tickets. The actual odds of being drawn for a Grand Prize depend on the number of eligible entries received.
4.1 Use of Personal Information. Personal information collected from Eligible Entrants will only be used to administer the contest. In addition, by entering the Grand Prize Draw, each Eligible Entrant acknowledges and agrees that if they are declared a winner, their name, city of residence, photograph, video or likeness may be used on the contest website and in other media at PRBC’s sole discretion without any payment or further compensation. Finally, if consent is given by an Eligible Entrant at the time of entry into the Grand Prize draw, PRBC may use such personal information to provide such entrants with information regarding upcoming promotions relating to PRBC’s products and/or events supported by PRBC.
5.1 All dollar amounts listed in these Rules are in Canadian Dollars (CAD).
5.2 By entering the contest, Eligible Entrants agree to abide by the Rules and that all decisions of PRBC with respect to all aspects of the contest will be final and binding.
5.3 All prizes must be accepted as awarded. No cash alternatives, substitutions or transfers of any of the prizes will be allowed. Once a prize has been awarded, the winner will have no further recourse to the Contest Parties.
5.4 PRBC reserves the right to cancel, suspend and/or modify the contest in whole or in part at any time and without notice, as PRBC determines in its sole discretion, for any reason, including, but not limited to, if events beyond PRBC’s reasonable control make continuation not feasible, or if the integrity of the contest is impaired, including but not limited to for reasons such as the loss or destruction of entries, or if a virus, bug, or computer, electronic or system malfunction, human error or another cause, should corrupt the administration, security or proper and fair play of the contest.
5.5 The Contest Parties will not be liable for any failure of the contest operating system, do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof.
5.6 The contest is subject to all applicable federal, provincial and municipal laws. All issues and questions concerning the construction, validity interpretation and enforceability of the Rules or the rights and obligations as between the Eligible Entrant and PRBC and the Contest Parties in connection with the contest shall be governed by and construed in accordance with the laws of the province of British Columbia without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. Eligible Entrants agree to attorn to the exclusive jurisdiction of the courts of British Columbia, Canada for determination of any and all matters related to the Contest.
5.7 The contest is void in whole or in part where prohibited by law.
5.8 By entering the contest, Eligible Entrants agree to hold harmless the Contest Parties against any and all liability, damages or causes of action with respect to or arising out of:
(i) the Eligible Entrant’s participation in the contest, (ii) the receipt or use of a prize awarded therein, (iii) the administration of the contest, and (iv) the distribution of the Grand Prizes. Eligible Entrants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including negligence) including (but not limited to) death, personal injury or loss or damage to property which the Eligible Entrant or any of the Eligible Entrant’s representatives, heirs, next of kin or assignees (“Representatives”) may have or which may hereinafter accrue to the Eligible Entrant or Representatives against the Contest Parties or as a result of the Eligible Entrant’s participation in the contest or use of a prize awarded herein.
